General terms and conditions
Article 1. Applicability
1.1 The general terms and conditions apply to all products found on our website.
1.2 BPC Autoparts is a trade name of Breda Parts Company; therefore, Breda Parts Company will be used hereinafter.
1.3 Deviations from the general terms and conditions are possible but must be documented in writing by Breda Parts Company.
1.4 By placing an order, you agree to the terms and conditions of Breda Parts Company.
1.5 Breda Parts Company is not liable for any (interim) price changes. Possible typographical errors in the system do not guarantee the delivery of products.
1.6 If we check a car part for you via TecDoc, we are not responsible for the accuracy of the provided data. However, you can return the part within 14 days. This does not apply to car parts that you did not verify with us. For those, you can only exchange the car part for another product. You must notify us within 14 days and exchange it within 30 days at the latest. This applies only to consumers. We provide a one (1) year warranty on all car parts.
Article 2. Formation (and Termination) of the Agreement
2.1 An agreement with Breda Parts Company is concluded when an order confirmation is sent via email to the email address provided by the customer. It does not matter whether the order was placed through the website or by phone.
2.2 The customer can cancel their order within 24 hours of the order date by sending an email to info@bpc-autoparts.nl.
Article 3. Prices, Products, Offers
3.1 All prices on this site are in euros and include VAT but exclude shipping costs.
3.2 Products (and special offers) are available (valid) while supplies last.
3.3 Products remain the property of Breda Parts Company until payment for the respective product has been received.
Article 4. Payment
4.1 Orders placed via this site can be paid in the following ways:
- via iDEAL
- cash payment (when picking up the product or having it delivered by Breda Parts Company at an agreed rate)
4.2 Shipping costs are always the responsibility of the customer and depend on the ordered item. The only exception is if Breda Parts Company sends the wrong item to the customer; in that case, we will cover the shipping costs.
Article 5. Delivery and Delivery Time
5.1 Orders will be delivered as soon as possible. Breda Parts Company aims to ship the placed order within approximately 48 hours (on business days), provided it is in stock. Do you want to ensure the product is in stock? Email info@bpc-autoparts.nl and receive a response within 24 hours on business days.
5.2 Once the ordered products have been collected, the transport risk transfers to the (business) customer.
5.3 Breda Parts Company is not liable for delayed delivery times caused by DPD or PostNL.
Article 6. Returns
6.1 If you receive an incorrect size/item from us, you must report it on the day of receipt. You are required to carefully inspect the products for deficiencies, damages, and other defects and report them within 48 hours of receipt. You may return or exchange the item (by post). We will, of course, reimburse the shipping costs.
6.2 If you ordered an incorrect item, it can be exchanged (unused and undamaged) within 48 hours. The shipping costs will be the responsibility of the customer.
6.3 Products can only be returned after prior written approval (via email) from Breda Parts Company and must be in their original, undamaged, and complete condition.
6.4 The buyer has the right to return goods without giving reasons within 14 days of receipt. After 14 days, Breda Parts Company will no longer process complaints or return requests.
6.5 Installed parts cannot be returned, nor can electronic/electrical parts. No warranty is provided for electronic/electrical parts. Electrical products refer to items that can be connected to an electrical circuit. Additionally, oil products cannot be returned.
6.6 Goods must be returned undamaged, unused, and in their original packaging.
6.7 Any amounts paid will be refunded within 30 days of receipt of the returned goods.
6.8 Return shipping costs are at the buyer’s expense. This applies only to consumers.
6.9 Business customers cannot cancel or return orders. The Distance Selling Act applies only to consumers. A company (including a sole proprietorship) cannot make use of this right.
Article 7. Warranty and Liability
7.1 We provide a start-up guarantee on all bikes, quads, and generators, meaning the product is undamaged and functions correctly. If this is not the case, you must report it via email within 24 hours.
7.2 We guarantee that parts and helmets are delivered undamaged and in good working condition. If this is unexpectedly not the case, you must report it via email within 24 hours. The product can be exchanged free of charge.
7.3 If you purchase a motorized vehicle from us in a box, we assume you have sufficient knowledge to assemble and adjust the item correctly. We accept no liability if this is not done correctly. See also "Important for You" on our website.
7.4 Breda Parts Company is never obligated to pay damages (in any form) to the customer unless there is intentional misconduct or gross negligence by Breda Parts Company.
7.5 If Breda Parts Company is required to compensate for damages, the amount will never exceed the invoice value of the related product.
7.6 Delivered items may differ from the website images in terms of color, print, shape, and model.
7.7 A warranty request must always be submitted in writing (via email).
7.8 We provide a 2-year warranty on JMJ diesel particulate filters. This warranty is offered by our supplier, JMJ in Poland, under the following conditions:
Warranty Period
- The warranty is valid for 2 years from the date of purchase.
- The diesel particulate filter must be returned to JMJ in Poland, and the shipping costs will only be reimbursed if it is found that the filter is malfunctioning.
Coverage
- The warranty covers material and/or manufacturing defects that occur under normal use.
Exclusions
The warranty does not apply in the following cases:
- Misuse, negligence, or improper use of the diesel particulate filter.
- Incorrect installation or assembly that does not follow the manufacturer's instructions.
- Damage caused by external factors such as accidents, extreme weather conditions, or the use of unsuitable fuels or additives.
Warranty Claims
To make a warranty claim, you must provide:
- The original purchase receipt.
- A clear description of the defect.
- Proof of correct installation by a qualified mechanic.
- The APK test report.
Evaluation and Processing
- After receiving your warranty claim, the defect will be assessed by JMJ’s technical team, which may take 2 to 6 weeks.
- A replacement product will not be provided.
- We reserve the right to reject warranty claims if the conditions are not met.
Article 8. Copyright
8.1 The photos on this website are protected by copyright. The use of these photos for personal or other purposes is strictly prohibited and punishable.
Article 9. Legal Rights
- All agreements between Breda Parts Company and the buyer are exclusively subject to Dutch law.
- Any disputes arising from or related to this agreement will be submitted exclusively to the competent court in Breda, Netherlands.
- The applicability of the Vienna Sales Convention (CISG) is expressly excluded.
